As you probably already know, we are facing stricter regulations on the sale and possession of psychomodulatory substances (kratom). On Monday, September 14, 2026, the so-called Lex Kratom was discussed by the government and the process of approving this new law began. In addition to the practical ban on CBD cannabis and nicotine pouches, we also face a harsh tightening of the sale and possession of kratom. The law still has to pass through the Chamber of Deputies, the Senate, and the president, but apart from minor changes, I would not expect a major departure. According to current plans, Lex Kratom will be effective from January 1, 2027, without a transition period.
The new obligations for the sale of kratom will include these rules:
- Sale only to users aged 21+ (instead of 18+)
- Ban on online sales (brick-and-mortar stores only)
- Stricter inspections and the deployment of high fines for sellers
- Blacking out of shop windows and an absolute ban on advertising outside the store
- Increase in license fees by 50% - detailed below
(production 200k CZK -> 300k CZK annually, the same for distribution, trade 20k CZK -> 30k CZK annually) - Increase in VAT from 12% to 21% (price increase of tens of CZK)
- Excise duty 2 CZK / gram (at least a price increase of +100 CZK / 50g bag)
- Criminalization of possession over 50 g / person (it is permitted to carry a maximum of 50 grams of powder per person – anything more is against the law and is subject to an excise tax on illegal kratom of 20 CZK per gram, and depending on the quantity and the purpose itself – whether the person further provided or sold it to other people, there is a risk of a fine, an infraction, or even a criminal offense)
- Only psychomodulatory substances (kratom) and nothing else may be sold in the store.
- Municipalities will be given the option to determine restrictions on the location of stores by decree, or to ban them entirely
Considering all this information, we are considering terminating our business in the Czech Republic and closing our brick-and-mortar store in Brno. However, we are still deciding how to proceed further: whether to risk losses amounting to hundreds of thousands of CZK and undergo further harassment by state authorities, or simply to finish after almost 8 years and focus on alternative options. The rule alone that a customer can practically buy only 50 grams in a single purchase is incredibly frustrating to us.
In January 2026, we opened a kratom e-shop in Austria. Currently, the situation there is that kratom is a collector's item and nothing is in the works. Over time, we are perhaps planning to open a brick-and-mortar store as well, but before that, maybe even a vending machine with age verification. It probably won't come as a surprise that most of our clients are Czechs and Slovaks, whether they are immigrants living abroad or just „travelers“.
Of course, delivering to the Czech Republic is not possible without a license and all the required formalities. We have set up our model so that there is the option to either pick up the kratom in person in Vienna at a friend's place or at mine, in the case of a larger quantity, or we ship via e-shop using GLS to pickup locations in Austria and Germany, where the customer can pick it up at a traditional parcel shop (tobacco shop, convenience store, and the like) or in a 24/7 locker. Simple, fast, and anonymous.
The prices are practically pre-regulation, where for example 1 kg of kratom from Indonesia costs 100 euros / 2440 CZK. Delivery is within two to three business days and I am always happy to help with the order. Of course, I do not recommend transporting it to the Czech Republic, but according to current legislation, it is less risky until the end of the year than from January onwards.
TLDR: We sell cheap, high-quality, tested, sterilized kratom (practically identical to the one in the Czech Republic) via GLS pickup points in Austria and Germany, or in person in Vienna by arrangement.
