Scope of Application<\/b><\/h5><p><span style=\"font-weight: 400;\">These GTC apply to all contracts concluded between Irena Klementov\u00e1 (Clement&#8217;s Store, as per the imprint) and customers via the online shop clements-store.at. Deviating conditions of the customer do not apply. The contractual language is German; these GTC are also provided in English for the information of customers.<\/span><\/p><h5><b>2. Conclusion of Contract<\/b><\/h5><p><span style=\"font-weight: 400;\">The display of products in the online shop does not constitute a binding offer, but an invitation to place an order. By clicking &#8222;Buy&#8220; \/ &#8222;Order with obligation to pay&#8220;, you submit a binding offer. The contract is formed upon dispatch of the order confirmation by e-mail. We reserve the right to refuse orders without stating reasons (e.g. in the case of incorrect orders or unavailability of goods).<\/span><\/p><h5><b>4. Products and Product Descriptions<\/b><\/h5><p><span style=\"font-weight: 400;\">We sell Kratom (Mitragyna speciosa) products exclusively as collectibles, botanical raw material, and for research purposes.<\/span><\/p><p><b>IMPORTANT NOTICE:<\/b><span style=\"font-weight: 400;\"> The products are NOT intended for human consumption (ingestion, consumption). Sales are made exclusively for scientific research purposes or as collectibles. By confirming the order, the buyer declares that they will not use the products for consumption.<\/span><\/p><p><span style=\"font-weight: 400;\">The seller assumes no liability for misuse of the products.<\/span><\/p><h5><b>5. Prices and Payment<\/b><\/h5><p><span style=\"font-weight: 400;\">All prices are stated in EUR. VAT is not shown (small business owner).<\/span><\/p><p><b>Payment methods:<\/b><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Online orders:<\/b><span style=\"font-weight: 400;\"> Payment in advance (bank transfer) or by card via a secure payment service provider. Goods are dispatched upon receipt of payment.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Shipping costs are displayed in the shopping cart \/ during checkout.<\/span><\/p><h5><b>6. Delivery<\/b><\/h5><p><span style=\"font-weight: 400;\">Delivery time for Austria and the EU: 3\u20137 business days from receipt of payment.<\/span><\/p><p><span style=\"font-weight: 400;\">Shipments are sent via GLS. Collectibles are shipped with insurance. Delivery delays do not entitle the customer to refuse payment.<\/span><\/p><p><span style=\"font-weight: 400;\">We deliver only to countries where the purchase and possession of kratom is legal. The customer is solely responsible for verifying the legal situation in their country.<\/span><\/p><h5><b>7. Right of Withdrawal<\/b><\/h5><p><span style=\"font-weight: 400;\">You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you took possession of the goods.<\/span><\/p><p><span style=\"font-weight: 400;\">To exercise your right of withdrawal, you must inform us (Irena Klementov\u00e1, Sevastopolsk\u00e1 348\/7, 625 00, Brno &#8211; Star\u00fd L\u00edskovec, info@clements-store.at) by means of a clear statement (e.g. by e-mail) of your decision to withdraw from this contract. You may use the model withdrawal form at the end of these GTC for this purpose.<\/span><\/p><p><span style=\"font-weight: 400;\">To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.<\/span><\/p><p><b>Consequences of withdrawal:<\/b><span style=\"font-weight: 400;\"> If you withdraw validly, we will reimburse all payments received from you, including delivery costs (except for additional costs arising from your choice of a type of delivery other than the least expensive standard delivery), within 14 days. The cost of returning the goods shall be borne by the customer.<\/span><\/p><p><b>Exceptions to the right of withdrawal (\u00a7 18 FAGG):<\/b><span style=\"font-weight: 400;\"> The right of withdrawal does not apply to goods which are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery. This applies in particular to opened product packaging.<\/span><\/p><h5><b>8. Warranty and Claims<\/b><\/h5><p><span style=\"font-weight: 400;\">Statutory warranty rights pursuant to \u00a7\u00a7 922 et seq. ABGB apply (2 years from handover). Please notify us of defects in writing (info@clements-store.at) within 2 months of their discovery.<\/span><\/p><p><span style=\"font-weight: 400;\">In the case of justified defects, we will, at our discretion, carry out repair, replacement, or reimbursement. In the event of a proven material defect, we will cover the cost of returning the goods.<\/span><\/p><p><i><span style=\"font-weight: 400;\">Note: If seals have been removed for hygiene reasons, claims based on dislike are excluded (\u00a7 18 FAGG by analogy). This does not apply in the case of a proven material defect.<\/span><\/i><\/p><h5><b>10. Liability<\/b><\/h5><p><span style=\"font-weight: 400;\">The seller&#8217;s liability exists only in cases of intent and gross negligence. Liability for slight negligence is \u2014 to the extent permitted by law \u2014 excluded.<\/span><\/p><p><span style=\"font-weight: 400;\">The seller is not liable for damages resulting from misuse or improper use of the products. The buyer is solely responsible for compliance with the laws and regulations applicable in their country in connection with the purchase and possession of the products.<\/span><\/p><h5><b>11. Data Protection<\/b><\/h5><p><span style=\"font-weight: 400;\">The collection and processing of personal data is carried out in accordance with our privacy policy, which is available at clements-store.at\/datenschutzerklarung.<\/span><\/p><h5><b>12. Jurisdiction and Governing Law<\/b><\/h5><p><span style=\"font-weight: 400;\">Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).<\/span><\/p><p><span style=\"font-weight: 400;\">The court of jurisdiction for merchants is Vienna. For consumers, the statutory jurisdiction applies.<\/span><\/p><p><span style=\"font-weight: 400;\">Online dispute resolution platform (ODR platform EU):<\/span><a href=\"https:\/\/ec.europa.eu\/consumers\/odr\"> <span style=\"font-weight: 400;\">https:\/\/ec.europa.eu\/consumers\/odr<\/span><\/a><\/p><p><span style=\"font-weight: 400;\">We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.<\/span><\/p><h5><b>13. Final Provisions<\/b><\/h5><p><span style=\"font-weight: 400;\">No subsidiary oral agreements exist. Amendments and additions require written form. Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.<\/span><\/p><h5><strong>14. Uncollected Parcels<\/strong><\/h5><p>If the customer fails to collect the parcel, they are obliged to cover all resulting shipping costs. The amount charged shall be determined as follows:<\/p><p>If the customer paid for shipping according to the price list in the shopping cart, this amount will be deducted from their payment.<br \/>If shipping was provided free of charge, the customer will be charged the actual shipping cost according to GLS carrier rates. This amount is similar to the shipping rates listed on our website, unless the parcel is oversized (over 6 kg), in which case a higher shipping cost may be charged based on actual expenses.<\/p><p>In both cases, a handling fee of \u20ac5 will be charged for packaging and order processing.<br \/>All of the above costs will be deducted from the advance payment received.
